Glossary — Performance Guarantee: Is this applicable, and how would it work?
This is not currently planned, but it could be considered during the contractual phase.
Article 9.2 — Insurance: We understand that insurance would not be necessary on our side, as we would work according to the drawings you provide — with the responsibility for design or technology errors resting with you or your design supplier. Our responsibility would be limited to manufacturing according to the provided drawings, within applicable standards. Could you confirm?
The insurance requirement does not cover the design of the products; it applies to the scope linked to this contract, namely manufacturing and material defects. This point can also be discussed further during the contractual phase.
Article 24.2 — Arbitration: Would arbitration in Belgium or France be acceptable?
Yes.

Article 9.2 — Declaration of Honour: Could you provide an example of the declaration of honour?
The document to be completed is enclosed. It is also available on our supplier portal when creating and submitting your offer.
General questions
Partial supply: Would it be acceptable to submit a quotation for partial supply, or is it mandatory to quote for the full scope (11 items x 3 units)?
As stated in Article 5.1 of the Instructions to Bidders: "The present contract is not divided into lots."
Delivery time: What is the projected delivery time for the full scope?
The goods are targeted to be ready for delivery within 3 months of the order.
Payment terms: As with our first order, would an advance payment upon signature of the contract, followed by full payment after FAT and prior to shipment, be acceptable?
Payment terms will be discussed during the contractual phase.
Delivery terms (Incoterm): Would EXW terms be acceptable, or is CIF Mombasa mandatory?
The tender requests CIF Mombasa, which remains our preference. However, we would still consider quotations offering an alternative Incoterm.
